Q: Can I provide a health discount plan to my employees on a tax-free basis the same as health insurance?

A: Yes. Most discount plans should qualify under the “de minimus” rules for tax-free benefits regardless of other issues. This allows employers to provide low cost benefits tax-free without worrying about the usual employee benefit rules. If the discount plan does not meet the “de minimus” threshold for price, then you should consider whether the plan is actually a combination of benefits or, alternately, whether it is just a really bad deal!
